that we have the battle over the san francisco 49ers. the question here is who gets to stake a claim to the team. here it is. first off, the niners bear the name san francisco as we all know. starting next season the 2014 season, they will call santa clara home. still it mayor ed lee tells the examiner he continues the franchise the san francisco 49ers no matter what. how about this? civic center plaza in san francisco where the mayor's office is is not lit up in red and gold as you might expect considering the fact that the tower was colored in orange and black no san francisco giants when they made the run for the world series. same story in santa clara. jamie matthews tells the amermey news his city is celebrating low key. city hall down here is also dark this morning. when it comes down to it, isn't it all about the fans? i don't think the fans really care. i spent some time in san francisco over the weekend and time in the south bay and i saw plenty of 49er love to go around. a lot of people sporting their 49ers jerseys and doing so with pride. live in santa clara, marla tellez,

, a developing story we're following in san francisco. police are searching for a man accused of setting his girlfriend on fire during an argument this afternoon. it happened shortly after noon today in the city's bay view district. monty francis in the bay view where he just spoke with the victim's family, this has to be hard for them to make any sense out of. >> it is certainly very hard, and family members watched in horror as this all the played out right here in the streets. the 25-year-old woman, we're told she suffered serious burns and she's now at the burn unit at st. francis hospital, the woman's clothes are still here, burned, visible on the street. we're told she attempted to throw off her jacket after her boyfriend doused her with a flammable liquid, then set her on fire. the victim's sister tells us the couple had been together for about six months, and they argued a lot. according to the sister, the couple was at the laundry mad just down the street, where they began to argue about their laundry, they were on their way back home and just outside the victim's house at about 12:

another to the hospital in san francisco. police say the shooting happened on naples street just off geneva avenue in the crocker amazon neighborhood. a 43-year-old man died at the scene. a second man was taken to the hospital with what's being called not life threatening injuries. the suspected shooter was seen running away from the scene. this is the city's third homicide of the year. >>> firefighters in san francisco searching for the cause of a two-alarm fire at an apartment building. firefighters say this one started in a three-story apartment building on 19th and california in the city's richmond district. you can see the flames and smoke billowing out of there through the roof. it took crews 45 minutes to finally knock this fire down. we're happy to report no one was hurt but nine people have not yet been allowed to return to their homes. >>> in south san francisco, police and fire investigators examining a suspicious fire at city hall overnight. witnesses say two dumpster fires were reported near one of the buildings in the city hall complex. one of the fires burned a fence.

in san francisco now challenging the city's ban on public nudity today. activists filing a federal lawsuit claiming the ban violates their right to freedom of everything and expression. they want the court to issue an injunction against that ban which is set to take effect february 1st. city attorneys, they say the court has upheld nudity banses in other cities in the bay area. a hearing will be held in federal court this afternoon. >>> we could find out today if the bay area's newest casino gets to open its penthouse gaming floor. san jose's police chief is stepping down tomorrow. but he has promised to make a decision about casino matrix's eighth floor before he leaves. the penthouse is designed to offer high-stakes gambling and a panoramic view of silicon valley. the chief, kris moore, has expressed concerns over the casino's ability to safely monitor activity on that top floor. >> all right. >>> you and i have been talking about this all day. perfect timing. good weather, today is thursday, that means tomorrow is friday. christina loren is bringing it all for us. >> i am. and y

quality will be a problem as we go through the forecast. clear skies right now in san francisco. what we are finding on the weather board as we look at the pacific, is any sign of storm activity is not 1,000 miles out the here but about 2,000 miles and you can see it clearly arcing off to the north. that is due to the circulation around high pressure. with that said, you will get your sunshine for this weekend and you will get plenty of mild temperatures. let's get a look on who will get in on some of the heat. as we go through saturday, half moon bay looks to hit 70, beach weather mixed in here. walnut creek 70 and dpil roy 70 and san francisco close with upper 60s. this is quite a bit of a jump. again, it will come a a cost with the spare the air in effect. with the worst air quality in the north and also for the central bay tomorrow. may want to limit that outdoor exposer if you suffer from allergies or breathing problems. >>> 36 in san jose and also 43 in los gatos. we will get the sunshine out here and we will feel the warmth and you will need the sunglasses and maybe even, get away

voluntarily met with san francisco police before he boarded a mid afternoon flight to atlanta. police say the sexual allegation involves crabtree inside a san francisco hotel early sunday morning. the day after the 49ers beat the packers. crabtree was not detained or arrested. he's willing to meet with police if they have additional questions for him. this is what his lawyer released in a statement from earlier today. on friday, january 18, 2013, michael voluntarily met with the san francisco police department and provided a statement. michael fully cooperated with the inspectors and will continue to do so throughout the investigation. out of respect and integrity for the process, we have no further comment at this time. as you mentioned, chris, once again michael crabtree has not spoken to reporters. at this point the 49ers have not made him available to talk to reporters. if that was the case, most likely he would be expected to talk football. later in sports, we'll preview the nfc championship game. we'll have a live report from atlanta. >> hard not to get distracted. >>> the hostage c
